Host Terms & Conditions
HOST ONLINE (HOST) is a supplier of commercial catering equipment to commercial customers, a company incorporated in England with company number 14208267, registered at HOST House, Newhouse Farm Industrial Estate, Mathern, Chepstow, NP16 6UD.
In this agreement the “Customer” means any person who places a business-to-business order via the HOST website. The “Goods” means any items sold or supplied by HOST.

Exclusions
- Host has given commitments as to the compliance of the Goods with the relevant specifications in Clause 2. In view of these commitments, the terms implied by sections 13, 14 and 15 of the Sale of Goods Act 1979 and sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 are to the fullest extent permitted by law, excluded from this Agreement.
- The Customer acknowledges and accepts the restocking fee set out within Clause 4.7.
- Statutory rights for Customers placing Orders as private consumers (as defined by law) are not affected.

Goods being Sold
- We aim to ensure that all product information on this website is accurate but provide no guarantee, representation or warranty as to the accuracy.
- All product images are for illustrative purposes and on occasion there may be a difference in the image on site and the goods received due to changes in manufacturing or product re-development.
- These terms are the only form of contract between the Parties to the exclusion of and priority over any other agreement between the parties, and any order is subject to acceptance by Host. Orders may be cancelled at Host's discretion and receipt of payment and / or acknowledgement of an order is not confirmation by Host of an order.
- The Customer must ensure that premises are suitable for the goods supplied. All installations must be completed by a qualified fitter. Host reserves the right to see installation reports for warranty claims.

Payment Terms and Pricing
- Prices are quoted excluding VAT - orders are subject to VAT charged at the applicable rate at the time of order.
- Host reserves the right to update prices on the website at any time.
- Occasionally an error may cause the product price / description to be incorrect. Host shall be under no obligation to honour the incorrect price or order.
- Payment for Goods, Warranty and Delivery must be received by Host in full before an order is accepted.
- All orders may be subject to further credit or security checks.

Risk and Title
- Risk and title in the Goods transfers to the Customer at the time of completion of delivery.

Delivery
- Full prices and delivery options are listed on the HOST website and are subject to change.
- Free of Charge delivery is generally restricted to mainland United Kingdom. Additional delivery charges may be charged to remote areas, with extended delivery lead times.
- Standard Delivery and Premium Delivery orders will be sent according to the published delivery estimate, subject to the order being complete and payment received by Host before 3pm UK Mainland Monday - Thursday, providing the goods are in-stock and available.
- Host will endeavour to meet delivery estimates in all cases but cannot be held liable for any loss or damage due to delay in delivery.
- Goods delivered are used, stored, and installed at the Customer's own risk, Host does not accept any liability for any damage, loss, or disruption.
- At the point of placing an order the Customer must confirm any restrictions that may affect delivery in any way - such as access limitations, weight limits, pedestrian zones. If our delivery partners are unable to complete a delivery due to unknown restrictions, either a redelivery fee or return delivery and restocking fee of 20% of the order value will be charged.
- A redelivery fee will be charged if no one is available to take delivery of the goods.
- The Customer is responsible for ensuring that all items will fit within the premises and is advised to check the intended access point and route to destination. Any aborted delivery and restocking charges will be passed on to the customer.
- Before signing to accept the delivery, you must ensure that the product is correct according to the original order. Signing to accept the delivery confirms that you are accepting the product as seen. Any missing goods, or damage must be reported to the delivery partner at the time of delivery and must be reported to Host within 24 hrs of delivery via our Customer Form.

Warranties
- All products are offered on a 12-month parts only warranty basis within UK Mainland as standard unless specified otherwise in writing. We do offer further warranty coverage in addition to your statutory rights if you purchase this additional warranty coverage at the time of placing your order.
- All warranty claims must be submitted in writing via the Warranty Page on Host's website. All warranty claims must be submitted within 24 hours of the fault arising.

Where warranty coverage is stated to be provided on a parts only basis, unless stated otherwise in writing, we reserve the right to:
- ask for a copy of an authorised engineer's report before a part requested under warranty is dispatched;
- request the goods are sent to our premises for inspection at the cost of the Customer - if no fault is found, goods will be returned to the Customer and return costs will be the liability of the Customer; or
- send a replacement part.
- Where warranty is provided on a parts only basis and replacement parts are required, it is the responsibility of the customer to engage the services of an authorised engineer to diagnose the problem and to then fit any replacement parts. We do not provide or cover the charge for any labour or engineer services or charges.
- The warranties in this Clause 6 do not apply to any defect in the Goods caused by the fault, negligence, or failure of the Customer to use the goods for their normal intended purposes or failure to adhere to manufacturer instructions (including storage, use in incorrect environment, maintenance, de-scaling and cleaning). Gaskets, refrigerants, filter driers, shelves, tray slides, castors and legs, electric lamps, fuses, keys, locks, glass, filters, mains plugs and leads, hose connections and consumables are warranted to be free from defect on delivery only and any damage caused due to delivery must be reported to Host within 24 hours to qualify for replacement, repair or refund at our discretion. Goods marked ‘semi-commercial', ‘light-duty use only' or similar must not be used as substitutes or replacements for heavy-duty or commercial-grade equipment. Goods marked ‘no commercial warranty' are sold without any warranties unless otherwise stated. Certain Goods may be disposed of in accordance with.
- The warranty does not cover defects caused by transport damage incurred outside our responsibility, non-professional installation or assembly, misuse, inadequate maintenance, or failure to observe the use or installation instructions.
- Services or parts supplied under warranty neither extend the warranty period, nor start a new warranty period. The original warranty expiry will stand in all cases.
- Customers may purchase an extended warranty based on 12 months parts and labour, or 24 months parts and labour. Goods reported faulty within the specified warranty period may be repaired, replaced, or exchanged at HOST's discretion. Parts and labour under this warranty are guaranteed in the UK mainland only. Please see separate terms and conditions for extended warranties.
- Old electrical & electronic equipment may be disposed of by prior arrangement in compliance with WEEE regulations.

Cancellation
- Order cancellations must be made in writing, via our Live Web chat service or Cancellation Form.
- Any order cancelled after the first two hours following payment, but within 12 hours, a return delivery fee will be charged.
- If you wish to cancel your order more than 12 hours following payment, a restocking fee of 20% and return delivery charge will be applicable. Return delivery charges will depend on the goods ordered.
- If you do not cancel your order but refuse your delivery - you will be charged for the return delivery and restocking fee.

Returns
- Returns must be requested via the Returns Form and must be within 7 days of delivery, with goods to be received back to Host within 7 days of Host approving a return.
- Subject to Clause 8.1, Goods sold may be returned for a refund providing the goods are unused and in their original packaging. Returns are available on a collection only basis, with the Customer charged for the returns collection cost. The restocking charge for returned items in original condition is 20% of the full invoiced amount. We reserve the right to charge a higher restocking fee if the product condition differs from the above.
- Refunds will only be paid once the returned goods have been inspected and after deduction of any restocking or return charges have been made. We will also deduct any costs for repairing any damage or replacing any missing components that were supplied with the original order. Refunds will be made within 7-14 days after being approved Host.
- If an item is returned as faulty and after inspection no fault is found, the customer will be charged return shipping and / or a restocking fee.

Termination
- Host reserves the right to cancel or hold any order where payment has not been received or has failed subject to credit checks or otherwise.

Liability
- The Customer agrees that Host will not be liable for any losses or damage suffered by the Customer including but not limited to damage to neighbouring or connected items or premises, consequential loss, loss of profit, loss of business, business interruption or loss of time due to the use or purchase of the Goods by the Customer. Host will not be liable for any additional damage caused by the Customer's failure to report a fault or defect in good time. Nothing in this Agreement shall exclude Host's statutory liability for injury or death caused by negligence, fraud or fraudulent misrepresentation or any other form of liability that cannot be legally limited.
- Subject to Clause 10.1, Host's total liability to the Customer in respect of all breaches of duty shall not exceed the total order price.
- Goods sold are not insured for delivery unless otherwise confirmed by Host.
- The Customer agrees to indemnify and hold Host harmless for any breach of, infringement or misuse of any intellectual property right owned or enjoyed by Host.

Jurisdiction
- This Agreement is governed by English law and the Parties shall be subject to the exclusive jurisdiction of the English courts.
- Any right or obligation contained in this Agreement shall be distinct and severable and if one or more of the same are declared invalid, illegal, void or unenforceable then the remainder shall continue in force and effect to the fullest extent permissible by law.

Vouchers
- From time-to-time Host may send you by email or post web vouchers. These are codes which you may input on our website to qualify for certain promotions (Promotions). Vouchers are subject to the terms and conditions of this Agreement and any terms and conditions notified to you at the time of issuance of the voucher.
- A web voucher is redeemed by entering its code at the appropriate point in the purchase process on the Website.
- We reserve the right to withdraw or cancel a voucher for any reason at any time.
- A voucher cannot be exchanged for cash, is non-transferable and non-exchangeable.
- Unless expressly stated at the time of issue, each voucher will be valid for use by the recipient of the voucher and by such recipient only once and may not be used in conjunction with any other Promotion.
- In accordance with guidelines from HM Revenue and Customs, a voucher is treated as cash, therefore VAT is due on the full value of an order and you will be required to pay VAT on the full value of the order, unless otherwise stated in any terms accompanying the voucher.
- From time-to-time certain products may be excluded from voucher offers and any such exclusion will be notified to you along with the voucher, through the Website, social media platforms, via email or in the Specific Terms. Excluded goods will not count towards any qualifying conditions for offers and will not benefit from any promotional discount.
- A voucher shall not be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, without our prior written permission.
- Vouchers distributed or circulated without the written approval of Host, for example on an Internet message board or on a "bargains" website, are not valid for use and may be refused or cancelled.
- If we reasonably believe that any voucher is being used unlawfully or illegally we may reject or cancel any voucher and you agree that you will have no claim against us in respect of any rejection or cancellation. We reserve the right to take any further action it deems appropriate in such instances.
- If we refuse a voucher submitted as part of an order, for any reason, we will inform you before the order is dispatched to advise of the correct cost of the order and give you the opportunity to cancel the order.

Promotion Administration and Exclusion of Liability
- Any attempt to deliberately damage the Website or the information on it, or to otherwise undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, Host reserves the right to seek damages to the fullest extent permitted by law.
- Host may vary the terms of, or terminate, the Promotion at any time where it has reasonable grounds to do so at its absolute discretion without liability to any entrant or other person.
- Host’s failure to enforce any one of the terms and conditions of this Agreement in any instance(s) will not give rise to any claim or right of action by any entrant, nor shall it be deemed to be a waiver of any of our rights in relation to the same.
- To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any user of a Promotion in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, loss of saving, damages and other liabilities, provided that nothing herein shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence.
